REGULATIONS OF THE STUDENT DORMITORY
OF THE KRZYSZTOF PENDERECKI ACADEMY OF MUSIC IN KRAKOW
from the appendix to the Rector’s Ordinance No. 30/2022
as amended with the Rector’s Ordinance No. 25/2023
§ 1
General information
1. The Regulations of the Student Dormitory of the Krzysztof Penderecki Academy of Music in Krakow, hereinafter referred to as Regulations, define the rules of using the student dormitory, accommodation and check-out, rights and obligations of the residents, payment rules, the template of accommodation agreement, the resident’s financial liability, the composition and powers of the Residents’ Council, rules of order and visiting rules in the SD.
2. Student Dormitory of the Krzysztof Penderecki Academy of Music in Krakow at Przemyska 3 street, hereinafter referred to as SD, is a place of accommodation, learning and rest of residents.
3. The SD is the property of the Krzysztof Penderecki Academy of Music in Krakow and is under special protection and care of its residents and staff, doing their best to maintain it in proper state and condition, including especially the SD Administration Staff and SD Residents Council who shall cooperate on entrusted tasks, following the principle of the mutual respect of laws, duties and responsibility.
4. Detailed criteria and mode of awarding grants for accommodation are specified in the Regulations of scholarships and grants for AMKP students.
5. Application for accommodation in the SD shall be submitted in the AMKP Teaching Office by a deadline published on the website of the Krzysztof Penderecki Academy of Music in Krakow. The template of the application for accommodation in the student dormitory is attached to the AMKP Regulations of scholarships and grants as an appendix No. 9.
6. The place in the SD is assigned from October 1st to the day after the last day of summer examination session. In justified cases resulting from the didactic process a student or doctoral student may apply for a prolongation of accommodation. Any AMKP student, doctoral student or intern may be accommodated beyond the period of didactic classes and session – on the basis of reservation approved by the Head of the SD.
§ 2
Fees and accommodation contract
1. The fee for a place in the SD is set every year by a separate Rector’s ordinance on the fees prevailing in the Student Dormitory and consists of:
1) a monthly fixed fee for a place in the SD – charged for each month in advance,
2) a variable fee for utilities used – as indicated by meters – charged in arrears.
2. The template of accommodation contract is attached as an appendix these Regulations.
3. Parties may terminate the accommodation contract before the end of the period for which the contract has been signed, with a prior one-month notice period, effective at the end of the month, except for June – contracts terminated in June end within the date pointed in § 1 sec. 6. The contract termination notice requires a written form.
4. One month delay in payment results in the loss of the place in the SD, and in such a case the security deposit will be used for payment of the outstanding fees.
§ 3
Rules of check-in and check-out in the SD
1. Check-in is provided by the Student Dormitory Administration based on a register of persons delivered by the Teaching Office, and approved by an appropriate Vice Rector for student affairs.
2. Check-in for students in the SD starts on September 28th, and ends on October 3rd. The residents who fail to check-in within this period and fail to inform the SD Administration on the reason of later check-in by email, will lose their place in the Student Dormitory.
3. The place in a room is assigned by the SD Administration. The places may be swapped only after prior approval of the SD Head.
4. Each resident shall pay a compulsory security deposit before check-in. The security deposit shall be returned after check-out, within 14 days.
5. At the day of check-in a resident:
1) turns up with an identity document (ID card or passport),
2) submits the receipt of payment of the deposit to the AMKP account,
3) signs the accommodation contract.
6.The resident of the SD shall inform the Head of the SD on the planned check-out date at least 14 days before this date.
7. The resident shall prepare the room for commission acceptance at least one day before leaving it. The resident must agree the deadline and details with the Student Dormitory administration.
8. Room shall be turned over, and equipment, bedding etc. shall be returned by the resident in no worse condition, resulting from normal use.
9. The SD Administration accepts the room at check-out.
10. A resident of the SD shall return the relevant equipment and bedding to the storage room.
§ 4
Material liability
1. After being accommodated, the student or another authorised person becomes a rightful resident and bears full liability, including material one, for the equipment of his/her room and other rooms of the Student Dormitory.
2. A resident of the SD bears financial consequences for:
1) cleaning service if required because of the resident’s failure to maintain cleanliness and tidiness in the room, bathroom and kitchenette belonging to it,
2) damage to furnishings and fixed elements of the room,
3) damage to or destruction of equipment owned by the Academy,
4) damage to the piano,
5) loss or damage to the room key received,
6) unjustified use of the fire system.
3. In case of damages done in the freely accessible places and when it is impossible to find the responsible persons, the costs of repair shall be shared accordingly by all residents of the Student Dormitory.
4. All cost of repair mentioned in sec. 2 that were not paid by the student on time, shall be deducted from the deposit.
5. In case of vandalism, the due amount to be paid may be increased by 100%. The decision is made by the SD Head after consultation with the Residents’ Council.
6. In case of refusal to voluntary cover the costs of damage, the regulations of Civil Code shall be applied.
§ 5
The Residents’ Council
1.The students of AMKP residing in the Student Dormitory shall elect from among themselves, as stated in this paragraph, the Student Dormitory Residents’ Council, hereinafter referred to as RC, composed of 3 persons.
2. The Residents’ Council is composed of the Chairman and two assistants. The Chairman and the assistants are elected by all the residents by simple majority of votes in secret ballot. The election meeting, which shall take place in the first month of the academic year, is summoned by the Residents’ Council of the previous term. In case of absence of the RC members, the meeting is summoned by the competent vice rector.
3. The information about the date of election meeting shall be put on the Student Dormitory notice board 7 days before the election. Participants of the election meeting (SD residents) appoint by simple majority of votes in open ballot the Election Committee, composed of Chairman, Assistant, and Secretary.
4. The candidates for the Residents’ Council as well as for the Election Committee can be proposed by each of participants of the election meeting. The candidates for the Residents’ Council cannot be members of the Election Committee.
5. The participants of the election meeting elect in secret ballot 3 members of the Residents’ Council from at least 4 proposed candidates.
6. The Residents’ Council term lasts one academic year.
7. The responsibilities of the Residents’ Council include:
1) representing the residents of the SD,
2) taking action to maintain order and tidiness on the SD premises,
3) checking the cleanliness of the rooms, in special situations, with the SD Head,
4) proposing renovations and making suggestions on SD equipment,
5) giving opinion on decisions concerning SD matters,
6) participating in resolving social and living issues of residents.
8. The Residents’ Council closely cooperates with the SD Head, however it has the right to object the decision of the SD Administration as far as the residents’ issues are concerned. The competent vice rector for student affairs acts as an appeal body, and then the rector.
9. The Chairman of the RC shall present at the end of an academic year the assessment of work of the head and administration of the SD to the Chancellor.
10. The Chairman of the RC participates in an advisory capacity in the meetings of the Academic AMKP Students’ Government Council.
§ 6
Rights and obligations of the SD residents
1. The SD residents have the following rights:
1) to use the premises, including the rooms and equipment for communal use i.e. laundry, lavatories and practice rooms,
2) receive guests on the premises of the SD during visiting hours.
2. The SD residents have the following obligations:
1) comply with the provisions of these Regulations,
2) pay all fees on time,
3) follow the guidelines of the SD Administration,
4) comply with health and safety protection, and fire protection regulations, including the Fire Safety Instructions,
5) read the information clause resulting from Art. 13 and Art. 14 of GDPR, published on the AMKP website,
6) use electricity and water in a rational and eco-saving manner, do not overheat bedrooms and other used rooms above 20 degrees, turn off heating in rooms during periods of prolonged absence,
7) take care of the entrusted property,
8) maintain cleanliness and tidiness in rooms and adjacent bathrooms and kitchenettes,
9) keep the areas of common use clean and tidy,
10) leave keys at the reception when absent,
11) immediately inform the Head of SD of any faults in bedrooms and other rooms, or any irregularities noticed, as well as suspicious behaviour of persons that may affect safety in the AMKP SD.
3. In case of infringement on these regulations a resident bears responsibility before:
1) the Head of the SD and the Chairman of the RC,
2) vice rector for student affairs and external relations.
4. The appropriate motions referring to the issues mentioned in sec. 3 can be made by the Head of the SD and the Chairman of the RC.
§ 7
Order regulations and rules of visiting the SD
1. On the premises of the AMKP Student Dormitory the quiet night hours are from 10.00 p.m. to 8.00 a.m.
2. Playing an instrument in the room between 8.00 am and 10.00 pm requires the consent of the roommate (quiet day hours).
3. On the premises of the AMKP SD the following activities are forbidden:
1) practising instruments and organising social gatherings in rooms and corridors after 10 p.m.,
2) using sound equipment in a way that disturbs other residents at studying and relaxing,
3) installing arbitrarily any installations and making any changes in the decoration and furnishing of rooms, including sticking posters, hammering nails, etc.,
4) storing foodstuffs on window sills,
5) throwing any objects out of windows,
6) placing advertisements, information, etc. outside places designated for that purpose,
7) carrying on business and personal sales,
8) consuming alcohol, using drugs and smoking tobacco products,
9) having animals,
10) sharing the room with other persons without the SD Head’s knowledge.
4. In justified cases, the SD Head or authorised employees (minimum 2 persons), in consultation with the RC Chairperson, have the right to enter the room, also in the absence of the residents.
5. The rules of entering of technical staff to residents’ rooms – in connection with performing their duties – are set by the Head of the Student Dormitory.
6. The SD Administration has the right to perform a periodic inspection of the rooms.
7. A resident of the Student Dormitory may receive visitors between 8.00 a.m. to 12.00 a.m.
8. A resident of the SD bears the full responsibility for his/her guests. This applies both to the room where the guest is received, and all other rooms for the common use on the premises of the SD.
9. A visiting person is obliged to inform on the room number he/she is visiting and to show his or her identity document.
10. The visitors to the SD may prolong their visit beyond 12.00 a.m. The conditions for prolongation are: to inform the reception, receive the consent of the other resident of the room, paying the appropriate fee for the occasional stay, and showing the identity document.
11. It is forbidden to offer overnight stays without the proper formalities, under the threat of losing the place in the Student Dormitory.
12. The amount of the fee for an overnight stay is established by the rector on a yearly basis with a separate ordinance.
§ 8
The loss of the right to accommodation
1. A resident shall lose the right to accommodation if:
1) he or she was removed from the list of students,
2) has not paid the fees on time,
3) violated these Regulations or the principles of social coexistence in any other way.
2. A resident who lost the right to accommodation is obliged to leave the Student Dormitory in 3 days from the date of the decision.
3. The accommodation contract is terminated with immediate effect on the day of the loss of the right to accommodation in cases mentioned in sec. 1.
